Child Custody is Awarded to Abusive STEP-Father?

Was the Judge sexist / racist? - He's Christian so it fits!

According to my source: this child has witnessed his mother ( Fawn Nichols of Georgia) receive physical abuse from her now ex-husband ( Derek Levi Nichols ). The ex-husband has no blood relation claim to the child. The step-father allegedly wanted nothing to do with the child until the divorce, but still had him call him daddy.

The Judge instead of granting an order of protection, awarded custody of her child to the stepfather. Fawn gets a mere 1 hour per month with her child and has to spend it with a supervisor and her ex-husband while he videotapes her. She also gets a single 15 minute phone call per month, and claims to be ordered to lie to her son about who his real father is who is said to be a very good man.

Fawn has been a homemaker for 4 years and claims no history of child abuse. She is denied the knowledge of what school her child attends, what doctor he sees. She's denied the ability to attend his pre-k graduation, his 6th birthday, any holidays, and his first day of kindergarten.

The Stepfather's brother, Kevin Lewis Nichols is a convicted child molester, registered sex offender, convicted drug user, and has been convicted of cruelty to children.

Judge Emerson is reported to have declined from hearing testimony from the investigator on the mother's behalf.

The mother has spent over $37,000 trying to get her son back. The Judge alledgedly ordered her to pay the stepfather's attorney fees for "bothering" him.

(A 17 year old boy was convicted of child molestation for having sex with a 15 year old girl with her consent (not a rape). Judge Emerson was the judge, the boy is black, Judge Emerson gave him 10 years!)

The uncle-in law is white, molested multiple girls under the age of 13 and received a mere 2 years and all his parental rights from the same judge.

Fawn Nichols claims to have no criminal background, and has a child psychologist ready to testify in her favor. She has many, character witnesses, including a 28 year old daughter that she raised herself who has become a prominent, upstanding citizen with no criminal history.

The child's pediatrician records contain statements about his incredible care - CN was born 9 weeks early by emergency C-Section and only weighed 3 pounds when he was born. Fawn believes because of her incredible care and motherly attention, he never had any of the premie problems that so many premies have -documented in his pediatrician's report.

The video of the child includes all parts to demonstrate his healthy personality, and lack of coaching.

The mother has indicated that she was unaware of being video taped but suspected an audio recording.

The tape mentioned allegedly has a dialog between the mother and stepfather with the stepfather threatening to pound her face in, cut her into little pieces, and throw her body all over GA so that no one will find her or know what happened to her. The child is said to be a witness to these events but didn't know what was on the tape.

Fawn contends that they both Knew that Derek wasn't the father, but Derek got the test for appearance sake. Judge Emerson reportedly refused to listen to an audio tape where Fawn told Derek he wasn't the father with Derek's unsurprised response. -This along with the date on the paternity test.

This in an Order from Judge Emerson given after Derek allegedly disappeared with CN at 4am on Feg. 28, 2004 for approximately 25 days after being notified that Fawn wanted a divorce. Derek's contention was that Fawn had mental issues, was violent and was an unfit mother.

The Judge states "based on Fawn Nichols' fraudulent conduct" Derek and his attorney filed a dismissal for the accusation of Fawn being fraudulent (last image in this post). Fawn wanted a jury hearing and not to be heard by just Emerson. So how can I be guilty of fraud? In CN's video interview, he describes the event which took place on November 20, 2004. Emerson reportedly refused to view the tape.

Judge who fixed divorce cases sent to prison
