My brother ran from the cops and got away |

I was told by my brother that yesterday night he was traveling east bound on a local freeway. He was traveling at 130mph when he saw the swat car lights in his mirror. When he saw them he freaked out and decided that he was already facing a felony if he got caught. Then he decided to run. In the state of Nevada Police officers must request to pursue most of time that request is denied. He did get away and the police did engage in pursuit. The only time they will pursue is if they know that you have committed a crime.
I don't know about other cities or states in Nevada this is true. I have talked to many state and local police officers on this matter and they all say that this is true. I don't think i would try running. I just thought this was funny.
My friend alexclaton just got a ticket that we are going fight to court in February. It should be interesting to see how the court answers our questions and how they prove that we violated someone legal rights.
So wish me and alexclaton luck in court and hopefully we will get the ticket dismissed.

dont plan to fight... ill agree to pay only after they answer some questions....
ill get them to take a position and dig themselves a hole....
after all im entitled to be informed of the law and what i did wrong =P

Yes, even though they will attempt to proceed without a damaged party, they will have to at least state the claim against you. Most likely some legal fiction.

yes, and that richard guy seems to confirm his methods (ie u need a competent witness , and a complaining party to have jurisdiction.... they don't have a complaining party and impeaching the cop gets rid of the witness....)
sadly i haven't found a lot of what goes on in court so its hard to prepare cuz i don't know what to expect... ill just have to play it by ear and keep questioning their jurisdiction by asking for a complaining party if impeaching the cop fails or doesn't get the case thrown out.
if anyone has any sources that will show me how traffic courts work etc that will be greatly helpful in planning out what i can do and how they'll prolly react

from what i can tell that method doesnt work so well in usa....
also inferior courts like traffic courts care less bout constitutional rights etc...
ill stick the to lack of standing/jurisdiction angle as its seems to work better , also it makes more sense as to why a lot of time a ticket is thrown out if a cop doesnt show up (no witness)

omg thanx dude, talk about perfect timing ...
even more ammo to fukk with them
from what i understand its just a hearing to see if im guilty or not , in which case ill have to wait later for the real court thing
ill ask for a speedy trial so i can try this out
thanx very much for the support guys, knowing ur all cheerin me on will give me an added boost of confidence(so will most of my friends coming to court with me =P )
