Raw Video:Dramatic video caught by a news crew is forcing local police to answer some tough questions about proper procedure. The actions of a police officer captured on video are under review by the District Attorney for Washington County. An NBC15 news crew was in McIntosh for a different story when they caught the scene on camera.

McIntosh Police say the chase started as a routine traffic stop and quickly accelerated when Ronald Lee Reed would not stop his truck. When the police caught up with Reed, Officer Blaine Barnett fired a taser into Reed's truck. Barnett then pulled Reed out, threw him to the ground, and punched him one time on the side of the head. The video also shows Barnett slamming Reed's face into the asphalt street three times.

NBC15 News spoke with Billy Lathan who was standing with us and also witnessed the arrest. "Down to the ground! He pushed him down to the ground and got down on him. I reckon they handcuffed him," said Lathan.

Reed didn't spend the night in jail, though. He walked away with two misdemeanor citations for reckless driving and possession of marijuana.
Officers searched Reed's truck, but according to a court clerk, the citation says only a "small amount of green substance (was found and) presumed to be marijuana."

So, why use of the taser, the punch and the suspect's head being slammed to the street when Reed was cited for minor offenses?

For more than a week, NBC15 News has been trying to get someone from the McIntosh Police to talk about the tape, to see if proper procedure was followed. The chief wouldn't talk. The chief's name is Michael Barnett... and he's Officer Blaine Barnett's father.

The District Attorney has also not returned any of our calls.

As for suspect Ronald Reed and his family, they told us they did not want to talk on camera. His parents say they'll wait until they have consulted an attorney first, but they too are concerned the force used against their son was excessive.

One other point over which there is some confusion concerns a question as to which agency Officer Barnett was working for at the time of Reed's arrest. The McIntosh Police chief says he was working for the drug task force, a division of the district attorney's office. But the task force says he had quit the day before the incident and was working as a McIntosh Police officer, where he continues to work.

Vladimir Volfovich Zhirinovsky is a Russian politician, founder and the leader of the Liberal Democratic Party of Russia (LDPR), Vice-Chairman of the State Duma (Russian Parliament), and a member of the Parliamentary Assembly of the Council of Europe.

If I am to understand correctly, he's drunk on a train, sends an aide to the back to get his shotgun so he can hunt crows from the speeding train...gets trigger happy and so starts taking aim at chicken coups of the locals along the tracks as well. As if hunting crows from a train wasn't a bad enough idea.

Apparently this is a public train no less. I edited out the long lead in of him jabbering on and on and sending the aide to get his gun...I guess he's given to anti-semetic rants, which I think he was doing prior to this, but my Russian isn't so good.

This guy is the #2 in the Duma, and has run for president of Russia several times. To his credit, he stops long enough to wave to kids.

The video, recorded February 12th, shows Duanna Johnson in the booking area at the Shelby County Criminal Justice Center after an arrest for prostitution.The tape clearly shows a Memphis police officer walk over to Johnson - a transsexual - and hit her in the face several times.

"Actually he was trying to get me to come over to where he was, and I responded by telling him that wasn't my name - that my mother didn't name me a 'faggot' or a 'he-she,' so he got upset and approached me. And that's when it started," Johnson said.

Johnson said the officer was attempting to call her over to be fingerprinted. She said she chose not respond to the derogatory name the officer called her.

"He said, 'I'm telling you, I'm giving you one more chance to get up.' So I'm looking at him, and he started putting his gloves on, and seen him take out a pair of handcuffs," Johnson said.

The officer hit Johnson several times with the handcuffs wrapped around his knuckles. In the video, you can see the flash of the metal. The tape shows another officer holding Johnson's shoulders as she tries to protect herself.

After taking several blows, Johnson stands up and swings back.

"I was afraid. I had had enough. Like I said, I thought the other officers that were witnessing this would at least try to stop him," Johnson said. "I mean, he hit me so hard. Like the third time he hit me, it split my skull and I had blood coming out. So I jumped up," Johnson said.

But then she sat back down, and the officer her in the face again. Then he maced her. On the tape, other people in the room are seen turning away and fanning their hands because of the smell.

"We wanted some acknowledgement - my client did - so she would know that the Memphis Police Department didn't condone this," said Murray Wells, Johnson's attorney. "We were optimistic that they would be as outraged about this as we are, and we haven't gotten any indication that they're interested in it at all.

"These are the people we depend on to protect us, and I think the majority of officers in Memphis are good officers, and when you see what you see on that video, it's a scary sight to see that that could happen to any one of us," added attorney Aurthur Horne

On the tape, Duanna is eventually handcuffed and left on the floor. A nurse comes in, and goes directly to the officer.

"I couldn't breathe, and they just made me lay there," Johnson said. "Nobody checked to see if I was okay. My eyes were burning. My skin was burning. I was scared to death. Even the nurse came in and she just ignored me, and I begged her to help me."

The video clearly shows the nurse walk right past Duanna as she's rocking back and forth in pain in the background.

A copy of the tape was reviewed by both the FBI and the District Attorney's office, the latter of which dropped all charges against Johnson. An FBI investigation into possible civil rights violations is still underway.

Meanwhile, the Memphis Police Department confirmed that the officer holding Johnson was on probation, and has been fired. The officer who threw the punches is currently on non-enforcement status pending an administrative hearing.

CCTV:A federal civil rights lawsuit was filed this week against a Yonkers police officer who arrested a 44-year-old home health aide after having allegedly beaten her unconscious.
A suburban New York police officer was freed on $300,000 bail after being charged with using excessive force against a woman at a restaurant.

Yonkers Officer Wayne Simoes appeared Friday in U.S. District Court in White Plains. The 38-year-old officer was accused of violating the civil rights of Irma Marquez in March 2007.

Michael J. Garcia, the U.S. Attorney for the Southern District of New York, and Mark J. Mershon, Assistant Director in Charge of the New York Office of the Federal Bureau of Investigation, announced Friday that the officer was charged in a criminal complaint with violating the civil rights of Marquez by using excessive force against her, resulting in bodily injury.

Federal prosecutors said several officers responded to a call to assist an injured person at the restaurant.

They said Marquez was leaning over the injured person when an officer moved her out of the way. They said Simoes then grabbed her around the waist from behind, lifted her into the air and threw her on the floor, face down, before handcuffing her.

The violent attack, captured on surveillance video, resulted in the hospitalization of Marquez with a fractured jaw, concussion, two black eyes and facial lacerations, as well as bruises and swelling over her neck, torso and numerous other parts of her body, according to the complaint.

The videotape, which was reviewed by the Westchester County District Attorney Office’s, clearly demonstrates the officer lifting Marquez off her feet and driving her face first into the ceramic tile floor of the restaurant where the incident occurred, the complaint said.

Marquez was accosted by police when she leaned over to get a better view of the medical assistance being provided to her niece who was earlier rendered unconscious when struck by another assailant while patronizing the La Fonda Restaurant at 57 Palisade Avenue, Yonkers, N.Y., on March 3, 2007, according to the complaint.

The complaint said that Simoes slammed Marquez to the floor, then handcuffed and charged the unconscious and seriously injured woman with obstruction of governmental administration and disorderly conduct. On May 9, 2007, a jury acquitted Marquez of all charges.

In a statement, the Yonkers Police Department said that Simoes was placed on modified duty until further review of the incident.

According to the statement, "Commissioner Hartnett has directed the Internal Affairs Division to reopen the investigation to the facts and circumstances surrounding the incident. Due to the fact that this is an ongoing investigation, the Yonkers Police Department will not be commenting any further on it and all future inquiries should be made to the United States Attorneys Office."

“If anyone other than a police officer was caught on tape doing what Officer Simoes did to Irma Marques they would have rightfully been arrested and prosecuted,” said Gary T. Certain, Esq., of Certain & Zilberg, PLLC, who represents Marquez.

Certain, who represented Marquez in the criminal case and filed the federal lawsuit in the Southern District of New York, added, “This case suggests that Janet DiFiore’s office may not be capable of honestly prosecuting egregious police misconduct.”

The complaint charges Simoes with violating of federal civil rights laws, which make it a crime to willfully deprive a person of rights secured and protected by the Constitution of the United States.

If convicted, Simoes could face up to 10 years in prison and a fine of $250,000.

Video Contradicts Maricopa County's Version Of Events

PHOENIX -- Recently obtained surveillance video of a jailhouse slaying contradicts the official report from the Maricopa County Sheriff's Office, Phoenix station KPHO reported.

The footage from May 1 shows the slaying of inmate Robert Cotton by another inmate, Pete Van Winkle.

Van Winkle, who More.. is a member of the Aryan Brotherhood, has been charged with first-degree murder, according to MCSO's report.

In a press release sent the day after Cotton's death, MCSO claimed "nothing out of the ordinary appeared to be happening in or around that cell," and once Van Winkle dragged Cotton out of the cell, "detention officers rushed to the scene."

During the 15-minute video, it appears Van Winkle strangled and punched the other inmate, and jumped on Cotton's head.

Once Van Winkle drags Cotton's body out of the cell, it takes guards five minutes to arrive at the scene.

"Things can happen in the blink of an eye," said Scott Applebee, Cotton's brother. "Twenty minutes -- that’s not the blink of an eye. That’s somebody (who) didn’t do their job.”

Applebee said Cotton, who was in jail awaiting trial for auto theft, spoke to him two nights before his death.

"If there was any inkling about him being afraid or someone was after him, he would have told me," Applebee said.

He said Cotton was never violent, and -- although he was in jail -- he had recently taken steps to turn his life around.

According to the 500-page investigative report prepared by the sheriff's office, Cotton may have been killed because he refused to beat up another inmate for the Aryan Brotherhood.

No matter the reason behind the beating, security consultant Jess Torres said Cotton's death should not have happened.

"Where was the guard that was supposed to be monitoring the camera?" he asked. "That's the biggest question."

Torres, a former police officer, said a jail guard should have recognized what was going on.

"They’re trained to notice and they're paid to notice -- so, yes, I believe that they should have noticed," he said.

Maricopa County Sheriff Joe Arpaio refused to comment on the case; Cotton's family has filed a claim against the sheriff's office for $2 million.

According to Joe Torres, the sheriff's office knows "what went wrong."

"Now, whether they correct it or not, is going to be something else," Torres said.
