Can the 13th Amendment of the US Constitution dodge draft?
Section 1. Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction.
Section 2. Congress shall have power to enforce this article by appropriate legislation.
It has been tried, and the judges pretty much argued as such:
In order to use the Constitution as a defense, you must be willing to defend the Constitution -- and that includes fighting in wars for it, via conscription.
As far as I am concerned, I wouldn't kill anyone unless they're invading my country. This pre-emptive crap is just Orwellian double-speak.
